2. Who this applies to
People who write to José through this website's chat, WhatsApp or email to ask about his web development services.
3. What data is processed
- Through the website chat: what you write in the conversation and the page you write from. If you choose to leave your details so José can contact you, also your name, email, phone and message, and only if you tick the consent box, which starts unticked.
- Through WhatsApp or email: your name, your number or email and what you write.
- Technical data: the chat does not store your full IP address, only an encrypted fingerprint that changes every 30 days, to prevent abuse.
No sensitive data (such as health data) and no data about minors is requested. You do not have to provide it, and the chat asks you not to write it.
4. What it is used for
- Answering your question about José's services.
- Contacting you, if you authorised it, to talk about your project and send you a proposal.
- If you hire him, managing the project, invoicing and communication during the work.
Your data is not sold or handed over to third parties for advertising, and is not used to send you advertising without your consent.
5. Who else processes it
This website's chat runs on Flowy, a service that stores conversations and contact details on José's behalf: Flowy is the data processor and José remains the controller. Flowy in turn uses these providers:
- Vercel: Hosts the website, the chat and its server.
- Neon: Database where messages are stored.
- Upstash: Abuse control, without the message text.
- Groq: Artificial intelligence that drafts the chat replies (United States).
That is why chat messages are processed outside Colombia, and the chat says so before you write. WhatsApp is a Meta service with its own terms.
6. How long it is kept
- Chat conversations: deleted automatically after 30 days.
- Contact details left in the chat: up to 12 months after the last contact, or earlier if you ask for them to be deleted.
- If you hire him: for the project and as long as accounting and tax rules require.
7. Your rights
As the data subject you can, free of charge: access, update and correct your data; ask for proof of the consent you gave; find out how your data has been used; withdraw your consent and ask for deletion, unless there is a legal or contractual duty to keep it; and file complaints with Colombia's Superintendencia de Industria y Comercio (SIC), after first making your request to José.
8. How to exercise them
Write to ingeniero.sanchez.06@gmail.com or via WhatsApp at +57 305 262 4583, with your name, how to reach you and what you are asking for. If someone asks on your behalf, they must show they represent you.
- Queries (what data exists and how it is used): answered within 10 business days, extendable by 5 more with notice of the reason.
- Claims (correct, update, delete or withdraw): answered within 15 business days, extendable by 8 more with notice of the reason. If a claim is missing information, you will be asked for it within 5 days; after two months without a reply, the claim is considered withdrawn.
9. Security
Conversations travel encrypted (HTTPS) and are stored separately from those of other businesses using Flowy. Only José can see them from his dashboard, protected by password and two-factor authentication.
10. Changes and validity
This policy applies from October 17, 2026. If it changes significantly, the new version will be published here with its date; if the change affects the purposes, your consent will be requested again.
